Both parties must have the legal capacity to enter into a contract. For a contract to be valid and enforceable, the parties involved must have the necessary capacity to understand the nature of the contract, its implications, and the obligations they are agreeing to. Minors and individuals with mental incapacity may not be able to meet this standard.
