Criminal Law: Constructive Liability Offences

Constructive offences are crimes where the defendant is held liable for a more serious offence than they intended to commit. For constructive crimes, the mens rea does not exactly correspond with the actus reus. Therefore, these offences are based on a legal fiction that treats the defendant as if they had the intention to commit the more serious offence.
