Criminal Law: What is Actus Reus?

Originating from the Latin for ‘guilty act’, actus reus is the physical conduct that comprises a criminal offence. In order to prove liability, prosecutors must prove that the defendant engaged in the prohibited conduct. Actus reus can consist of a positive action, a failure to act (omission), or the presence of a certain state of affairs.
